Terms of Service

1. Eligibility and Your Account

You must be legally able to enter into these Terms. If you are below the age of legal adulthood where you live, you may use the Service only with the permission and supervision of a parent or legal guardian who agrees to these Terms. If you use the Service for an organization, you confirm that you have authority to bind that organization.

Some features are available to guests; others require an account. Provide accurate account information, protect your sign-in credentials, and contact us if you suspect unauthorized access. You are responsible for activity you authorize through your account. Do not share or sell access to your account.

2. How the Service Works

EzColorize uses third-party AI models to process images you upload. Available models, processing steps, file limits, output sizes, queue times, and credit costs may differ by model and plan. Review the information shown before submitting a task. Processing time depends on demand and model availability; displayed progress and queue positions are estimates.

AI processing can invent or alter colors, textures, facial details, text, and other image content. Results may contain errors, differ between attempts, or fail to preserve a person’s appearance or the historical accuracy of a photograph. Review results before using or sharing them, and keep a separate copy of your original.

3. Your Images and Permissions

You retain the rights you hold in the images and other content you submit. You must own that content or have all permissions needed to upload it, process it through our service providers, and use the resulting images. This includes any copyright, privacy, publicity, or other rights of people depicted in the images.

You grant us a limited, non-exclusive license to host, copy, transmit, and process your submitted content, and to produce and deliver results, as needed to provide the Service and address support or security issues. This license does not transfer ownership of your content to us or give us permission to use your images in advertising without your separate permission.

Do not upload confidential material or images of others unless you are authorized to share them for this purpose. You are responsible for any notices or consent required before submitting personal information.

4. Using Your Results

As between you and EzColorize, we do not claim ownership of your processed images. You may use results subject to your rights in the original image, applicable law, and the commercial-use permissions of your selected plan. A plan’s commercial-use permission does not clear third-party rights for you.

We do not guarantee that AI-generated elements qualify for copyright protection or that results are unique. Do not present an altered image as an unmodified historical record or use it in a misleading way that harms others.

5. Acceptable Use

Do not use the Service for unlawful activity, infringement of intellectual property or privacy rights, harassment, fraud, impersonation, or deceptive evidence. Do not submit child sexual abuse material, non-consensual intimate imagery, or content whose creation or processing is prohibited by applicable law.

Do not interfere with the Service, bypass access controls, exploit vulnerabilities, distribute malware, or use automation that disrupts availability. Do not create multiple accounts or manipulate device identifiers to evade daily allowances, plan limits, or account restrictions. We may restrict activity that violates these Terms.

6. Credits and Daily Allowances

Tasks use the number of credits shown for the selected model when you submit them. We deduct available daily credits first, then purchased credits. Daily allowances reset at midnight UTC, do not roll over, and may vary by plan. Purchased credits do not expire and remain available until spent, subject to lawful account closure and any applicable refund rights.

Guest allowances are associated with a device and may depend on cookies and device recognition. When a guest device is first linked to an account, its remaining daily allowance replaces that account’s daily balance for that day; the two balances are not added together. Changing browsers or devices does not entitle you to additional free allowances.

If a processing task is marked as failed by the Service, its credit charge is returned to the daily and purchased balances from which it was paid. A task that completes but produces a result you dislike is not automatically treated as a failed task. Contact support with the task details if you believe a charge or result needs review. Credits are service units, cannot be transferred or resold, and are not redeemable for cash except where required by law or an applicable refund.

7. Paid Plans, Billing, and Refunds

Where purchases are available, the checkout must show the price, currency, applicable taxes, included credits or benefits, and any recurring billing terms before you confirm payment. Selecting a plan on a pricing page alone does not complete a purchase. We do not charge you merely for viewing or selecting an unavailable purchase option.

A subscription renews only on the recurring terms disclosed and accepted at checkout. You may request cancellation through the account controls provided or by contacting support. Unless the purchase terms or applicable law provide otherwise, cancellation stops future renewals and your paid benefits continue through the period already paid for.

For billing errors, duplicate charges, unused purchases, or service problems, contact support with your account email and transaction details. Any refund depends on the circumstances, the terms disclosed at purchase, and applicable law. Returning task credits is separate from refunding a payment. Nothing in these Terms removes any mandatory cancellation, refund, or other consumer rights, and use of the Service alone does not waive those rights.

Changes to paid pricing or recurring terms apply prospectively and will be communicated before they take effect where required. A change to future task pricing does not change the credit charge already recorded for a submitted task.

8. Privacy and Image Storage

Our Privacy Policy explains how we handle personal information, including uploaded images and information shared with service providers. Please read it alongside these Terms.

The Service is not a permanent backup or archival service. Storage availability and retention may depend on your plan and the information shown in the Service. Download results you want to keep. Do not assume an image link is private: anyone who receives a publicly accessible link may be able to open or share it. Contact support for questions about access or deletion.

9. Our Website and Third-Party Services

The EzColorize name, website design, software, and other materials we provide are owned by us or our licensors. These Terms permit you to use the Service; they do not transfer rights in our branding or software. Rights in your own images are addressed separately above.

The Service depends on hosting, authentication, AI processing, and other third-party services. Interruptions or changes to those services can affect availability or results. External websites linked from the Service have their own terms and privacy practices.

10. Availability, Suspension, and Termination

We may maintain, update, or change the Service, including the models offered. We do not promise uninterrupted availability or the continued availability of a particular model. We will give reasonable notice of material changes affecting paid access where practicable and required by law.

We may suspend or terminate access for material violations of these Terms, unlawful activity, or a threat to the security or operation of the Service. Where appropriate, we will give notice and an opportunity to resolve the issue. You may stop using the Service at any time and contact support about closing your account. Any treatment of unused paid balances on closure remains subject to applicable law and your purchase terms.

11. Disclaimers and Liability

We provide an automated image-processing tool, not a guarantee of historical accuracy, identity preservation, or suitability for a particular purpose. To the extent permitted by law, the Service is provided on an “as available” basis without additional warranties beyond those expressly stated in these Terms or required by law.

To the extent permitted by law, we are not responsible for indirect or consequential losses, lost business profits, or losses caused by uses of results that could not reasonably have been anticipated. You should keep originals and review outputs before relying on them.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded or limited. Nothing limits the statutory rights or remedies you have as a consumer.

12. Governing Law and Disputes

These Terms are governed by the laws of Hong Kong, subject to any mandatory consumer protections that apply where you live. Please contact support first so we can try to resolve a concern directly; doing so is not a condition of exercising your legal rights.

Subject to applicable mandatory law, disputes may be brought before the courts of Hong Kong. If you are a consumer, these Terms do not prevent you from using any court, regulator, or dispute-resolution process available to you under mandatory local law.

13. Changes to These Terms

We may update these Terms as the Service changes. The date above identifies the current version. For material changes, we will provide reasonable notice through the Service or another appropriate channel where required. Changes apply from their stated effective date and do not retroactively remove rights relating to earlier purchases. If you do not agree to updated Terms, stop using the Service and contact us about any existing paid access.

If a provision is held unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision does not waive our ability to enforce it later.
